DO YOU KNOW … you should NOT do a field sobriety test?

The field sobriety “tests”

Let me be crystal clear on two points:

First, the dexterity exercises known as “Field Sobriety Tests” are unscientific nonsense with very little relationship to intoxication and even less reliability.  According to many DUI lawyers in Fairfax, Prince William, Manassas, Manassas Park, Gainesville, Haymarket, Woodbridge, Lake Ridge, Dumfries, Bristow, Warrenton, Centreville, Stafford, Chantilly, Leesburg, Ashburn, Sterling, Herndon, Reston, Alexandria, Annandale, and Arlington, they are, quite simply, a fraud on the American courts. Unfortunately, poorly trained or untrained judges “buy into” the reliability of roadside testing as proving impairment, which is 100% incorrect.

It seems that a great many judges have not had the opportunity to hear (or simply don’t care) how unscientific and unreliable these “tests” are. It appears that many judges feel that if the government established and endorsed the use of these exercises, they must somehow be good tools to determine intoxication. As we will see, a few judges are starting to learn the truth behind these fraudulent “tests”.

Second, Field Sobriety Tests are VOLUNTARY. You don’t have to take them, and you never should, no matter how sober you are. They are NOT designed to determine if you’re intoxicated; they’re designed to fail you and justify an arrest. Nothing more. DO NOT DO FIELD SOBRIETY TESTS. You don’t have to do them and you can’t pass them.

In every other state in the United States, an expert witness’s testimony is only admissible if it is “reliable and relevant” (in some states) or based on facts “accepted by the scientific community” (in the rest). Only Virginia permits expert testimony without one of these two findings by the judge.

Thus, Virginia is one of the only states that do not require police officers to administer any particular field sobriety tests.  Many DUI lawyers in Fairfax, Prince William, Manassas, Manassas Park, Gainesville, Haymarket, Woodbridge, Lake Ridge, Dumfries, Bristow, Warrenton, Centreville, Stafford, Chantilly, Leesburg, Ashburn, Sterling, Herndon, Reston, Alexandria, Annandale, and Arlington feel the officer is free to dream up any test he wishes and, when he does use one of the tests common in other states, is not required to show that he did them in a manner consistent with their training, despite the fact that the National Highway Traffic Safety Administration training manuals state that incorrect administration of the evaluations by the arresting officer “compromises the validity” of the tests. In short, courts in Virginia have so far paid very little attention to actual science when it comes to DUI cases.

A great DUI lawyer will be trained in field sobriety “testing” and is able to expose weaknesses in the officer’s administration of these exercises. A “Dump Truck Lawyer” has likely never been trained in field sobriety “testing” and may not have the slightest idea how to effectively cross-examine the officer about them.
