Claiming “desertion” in a Virginia divorce
Written by our divorce lawyers in Manassas
There are a fair amount of reasons for filing a divorce, and most of them have to be handled carefully.
For example, desertion sounds simple, but there are many ways to define it in the court of law. A person may be justified in leaving (deserting) the marriage if they’ve been told to get out, if they’ve been abused by the spouse, if the conduct of the spouse is causing the other person to suffer health or mental problems, or if the living conditions in the marriage are intolerable. However, nothing is clear-cut when you are facing another divorce lawyer who is battling for your spouse. Things can get tricky and rough.
We can help! For more than 30 years our divorce lawyers in Manassas have been helping individuals with divorces in Manassas, Prince William, Manassas Park, Gainesville, Haymarket, Woodbridge, Lake Ridge, Dumfries, Bristow, Warrenton, Centreville, Fairfax, Stafford, Chantilly, Leesburg, Ashburn, Sterling, Herndon, Reston, Alexandria, Annandale, Arlington, and throughout Northern Virginia.
You should also be aware that you can charge your spouse with “constructive desertion” when your spouse has not, or will not, physically leave the marital residence, but through horrible actions has essentially already left or deserted the marriage.
According to our divorce lawyers, when a spouse has been abusive or cruel, and his or her behavior is so severe that the other spouse has to leave the home to escape, the cruel spouse is said to be guilty of “constructive desertion”, even though that spouse remains in the home.
Once again, all of these situations will be manipulated around by the opposing divorce lawyer and we recommend that you contact one of our experienced divorce lawyers so that the tables are not tuned on you.
