Trusts are created by an individual or entity, known as a “Grantor” or “Trustor,” to maintain certain assets which are transferred into the Trust. The Trust agreement appoints a “Trustee” who holds legal title to the property in Trust, and who manages and administers the trust pursuant to the Trust provisions, and the law.

In most instances, a Trust formed for estate planning purposes is revocable so the Trust can be changed or revoked during the Grantor’s lifetime, or property can be moved in or out of the Trust during the grantor’s lifetime.

A Trust becomes irrevocable upon the death or incapacity of the Grantor. Unlike a Will, which becomes public when recorded, a Trust is private and is not recorded in most instances. For that reason, a Trust offers greater privacy than a Will.
