The new, amended expungement law in Virginia starts on July 1, 2026. This law expands the types of offenses that can be sealed or expunged, including certain low-level felonies and misdemeanors, and also eliminates filing fees for those seeking to seal their records.

- Effective date: The new law becomes effective on July 1, 2026.
- What it does: The law expands the types of records eligible for sealing to include a wider range of offenses, such as low-level felonies (Class 5 and 6) and many misdemeanor convictions.
- Fee elimination: Another significant change the new law brings is the elimination of filing fees and court costs associated with sealing a record.
- What it does not do: The law does not eliminate the expungement process itself. Individuals will still need to petition the court to have their records sealed, and some records will be automatically sealed.
